Ross C. Wecker

Director

Ross Wecker is a Director at Kenney & Sams. He taps substantial project engineering education and experience as he asserts, and defends against commercial construction claims.  Ross represents general contractors, subcontractors, architects, engineers and other consultants on projects such as schools, shopping malls, hospitals and health care facilities, multifamily condominium and apartment complexes as well as road, sewer and pipeline projects.

In his construction law practice, Ross handles an even split of disputes related to public and private construction projects. Primarily, he represents general contractors on a full range of construction and business litigation issues including employment claims, litigation arising out of commercial transactions, leasing disputes and claims against vendors and suppliers.  He also represents subcontractors, and has substantial experience asserting their rights and protections related to bond claims and mechanics liens which can be bet-the-company situations that benefit from his understanding of timing, filing and statutory requirements to secure payment. Additionally, Ross represents architects and engineers in professional liability claims including claims of malpractice.

Ross analyses the strengths and weaknesses of his client’s situation and determines the optimal strategy for resolution through mediation or settlement to maximize recovery.  He views courtroom litigation as the strategy of last resort because he knows it benefits his clients to resolve disputes efficiently and cost-effectively.  That said, he and the firm are fully capable of handling any aspect of litigation or appeal.

Ross serves as lead counsel in multi-million dollar construction disputes relating to design defects and construction delays, breach of contract, payment claims, wrongful death and insurance coverage issues.  He litigates matters in Maine, Massachusetts, New Hampshire, New York, and Rhode Island.

Ross’s engineering degree is a significant advantage for clients because he is familiar with industry terms, plans, specifications, drawings and building processes, allowing him to analyze issues quickly and accurately. With his deep technical and business understanding, he reviews and negotiates contract provisions and responsibilities with clarity that discourages disputes.
